A qualified eIDAS timestamp (EU Regulation No 910/2014, Art. 41) enjoys a presumption of accuracy of the date and time and of the integrity of the data. An electronic document has the same evidential value as a paper document when the author can be duly identified and integrity is guaranteed (French Civil Code, Art. 1366); evidence may be provided by any means (Art. 1358). Why timestamping alone is no longer enough

The file is no longer the subject

Timestamping affixes a certain date to content. The operation is reliable and still useful. But it takes the file as presented.

A file can today be generated, moved or recaptured without a visible trace. The date will be exact. The event will not.

Frequently asked questions on photo proof

What is the difference between a timestamped photo and attested capture?

File timestamping proves that content existed at a date. It says nothing about whether the shot was real. Attested capture checks the moment of capture: device, scene, analysis. When doubt prevails, the proof is refused.

Is a certified photo enough when challenged?

It depends on what “certified” means. A stamp on a file already taken does not answer whether the scene was real. VERiXiS attests on-site capture and refuses an imported file. The right level depends on the stakes.

Does VERiXiS replace a judicial officer report?

Can I import a photo from the gallery?

No. On the strong proof path, capture happens in the app. No gallery file, no sending a photo already taken. That is what separates attested capture from timestamping after the fact.

What evidential weight, and how does eIDAS fit in?

The unitary seal relies on a qualified timestamp when the TSA provider is available. The evidential weight of digital proof is assessed case by case. VERiXiS documents the capture and seal integrity; it does not claim equivalence with an authentic deed.
