Rules for accessing and using VERiXiS: capture at shot time, web space, public verification.

1. Purpose
These Terms of use govern use of the VERiXiS service: production and review of photo or video proofs attesting that a scene was genuinely captured, then sealed. A qualified eIDAS timestamp (EU Regulation No 910/2014, Art. 41) enjoys a presumption of accuracy of the date and time and of the integrity of the data. An electronic document has the same evidential value as a paper document when the author can be duly identified and integrity is guaranteed (French Civil Code, Art. 1366); evidence may be provided by any means (Art. 1358). VERiXiS produces a sealed technical proof, not an authentic deed.
2. Publisher and acceptance
Publisher: MODULO44. Opening an account or using the service constitutes acceptance of these Terms of use and, where applicable, the Terms of sale.
3. Service description
- Capture at the time of the shot (photo or video). The web workspace is used for the library, dossiers, and verification.
- No imported files. Proof is born in the lens: capture happens exclusively at shot time.
- Every capture is analysed. If in doubt, capture is refused.
- Proof library, dossier composition, sealing. Each sealed proof remains intact when the dossier is sealed.
- Your counterpart verifies seal integrity themselves.
4. Accounts and access
You are responsible for keeping your credentials confidential and for use under your organization. Any fraudulent use or attempt to bypass capture controls may result in account suspension.
5. Proof content
You remain responsible for captured content. VERiXiS produces a sealed technical proof element with enhanced probative value, timestamped by a qualified eIDAS authority.
6. Availability
Service status is published at /en/statut. Any service level commitments appear in the Terms of sale or the Enterprise contract.
7. Intellectual property
Software, trademarks, and documentation remain the property of VERiXiS or its licensors. Media you capture remains yours. You grant VERiXiS the rights needed to store, seal, display, and enable verification.
8. Personal data
See the privacy policy and the DPA.
9. Liability
To the extent permitted by law, VERiXiS is not liable for indirect damages. Total liability is capped according to the Terms of sale applicable to the subscribed plan.
10. Governing law
French law. Competent courts: courts of Nanterre, subject to mandatory rules that apply.
